Argument 1
Claims against a governmental agency for loss of consortium cannot be maintained under MCL 691.1405, the motor vehicle exception to Michigan's governmental tort liability act, where the exception, by its express terms, only permits recovery for "bodily injury" and "property damage."
Argument 2
The motor vehicle exception, MCL 691.1405, limits the damages recoverable in an action brought pursuant to the wrongful death act, MCL 600.2922, to prohibit recovery for loss of consortium damages.
