RJRichard J. Joppich is a principal with Kitch, Drutchas, Wagner, Valitutti & Sherbrook, P.C.   He graduated from the Detroit College of Law (now Michigan State University College of Law) in 1988 after completing undergraduate studies at Bowling Green State University in Ohio.

 

A trial attorney with over two decades of courtroom experience in malpractice issues, Mr. Joppich has also provided extensive risk management, patient safety advisory, and educational services to dozens of healthcare facilities and organizations.  Closely tied to his litigation practice, he has developed extensive consulting services to attorneys, insurers, third party administrators, and various self-insured business entities on Medicare claims reporting compliance issues under the Medicare and Medicaid SCHIP Extension Act of 2007 (MMSEA Section 111), and Medicare rights of reimbursement management under the Medicare Secondary Payer Laws (MSP).

 

Mr. Joppich has been a frequent guest speaker for multiple organizations, governmental agencies, colleges, and universities on a national, regional, state, and local level concerning issues of Medicare reporting compliance, Medicare lien management, mental health recipient rights, and medical malpractice law and litigation. He has also been published on these and many other varied issues of law and practice in several statewide medical and legal publications.

Russell S. Whittle is the senior legal counsel and Vice President of MSP Compliance. Prior to joining Gould & Lamb, Mr. Whittle practiced primarily in the area of insurance defense, representing the interests of large insurers and employers in both workers’ compensation and general liability matters. He also developed and supervised the Medicare Set Aside and Medicare Secondary Payer Compliance department of a busy South Florida law firm.

 

Russell has litigated both first and third party accident and workers’ compensation claims in courtrooms throughout Florida and has also acted as a managing partner for the Fort Myers, Florida office of a large insurance defense firm. In 1995 he earned Board Certification from The Florida Bar as a Specialist in Workers’ Compensation Law. His varied experience has included real estate, title insurance, personal injury, and property damage cases.

 

Russell graduated from Skidmore College in Saratoga Springs, New York in 1986. He earned his J.D. from the University Of Miami School Of Law in Coral Gables, Florida in 1989. He is a member of the Workers’ Compensation Section of the Florida Bar, the Manatee County Bar Association, the National Alliance of Medicare Set Aside Professionals, Inc and is a member of the Steering Committee of the Medicare Advocacy Recovery Coalition (MARC). He has lectured extensively on Medicare set aside issues, Medicare Secondary Payer legislation and compliance, discovery, ethics, liability and workers’ compensation law, while remaining active in local bar associations and community activities.
