Jana M. Berger
Jana is an attorney in Foley & Mansfield's Michigan office.
She serves as defense counsel to various corporations in product liability, environmental toxin, and construction defect cases.
Jana obtained her Bachelor of Science degree from Northern Michigan University, and her Juris Doctorate in 1998 from Roger Williams University School of Law, located in Bristol, Rhode Island.
While earning these degrees, Jana remained active in school and community organizations while a charter member of Alpha Gamma Delta at Northern Michigan University, she founded a rifle team at the University, became the first female to take gold in the Upper Peninsulas Summer Sports Festival .22 shooting competition, served as a student ambassador for the University, and was named a Mortar Board Honoree.
Jana has knowledge on tribal gaming laws as well as experience with tribal law and tribal courts. In 1999, her article analyzing tribal gaming rights in support of Narragansett Tribal gaming in Rhode Island was published in Gaming Law Review. She is recognized by the International Masters of Gaming Law. Most recently, she successfully briefed and argued before the high court of a Michigan tribe on Constitutional issues of first impression. The ruling established a precedent within the system of tribal government and secured the membership of several disenrolled tribal members.
Jana also has served as amicus curiae counsel for the Michigan Association of Counties – representing over 80 counties within Michigan – on an issue of first impression before the Michigan Court of Appeals. Her briefing and oral argument led to the establishment of precedent in Michigan “fixing” attorney fees paid by counties on behalf of courts. The opinion is published at 46th Circuit Trial Court v Crawford County, 261 MichApp 477, 682 NW2d 519 (2004).
Jana is recognized as an expert on the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rules. She has been quoted as a HIPAA expert in Michigan Lawyers Weekly, and has published numerous articles on the Privacy Rules in Michigan Lawyers Weekly, Midwest In-House and Health Care Weekly Review. She has given seminars on this subject for the Michigan Association of Counties (MAC), the Michigan Association of Community Mental Health Boards (MACMHB), and the Michigan Municipal Risk Management Authority (MMRMA), as well as other public and private organizations.
In May 2006, Jana was awarded the Michigan Defense Trial Counsel Golden Gavel Award – Recognizing Rising Stars in Defense. She serves on the Board of Directors of the Michigan Defense Trial Counsel and in May 2006, accepted an invitation to serve on the Board of Editors of Michigan Lawyers Weekly. She is recognized by Who’s Who Metropolitan and, more recently, began teaching property law as a visiting professor at DePaul University in Chicago, Illinois.
Jana actively supports various charitable causes. She is a member of the State Bar of Michigan, Michigan Defense Trial Counsel and the Defense Research Institute.
