MDTC Amicus Update: Discoverability of Plaintiff's Facebook Profile   
 
Accessing the social media profiles of plaintiffs is a battle the defense bar is increasingly called upon to fight.  Without clear guidance from our appellate courts on this novel issue, Michigan Defense Trial Counsel persuaded the Court of Appeals to exercise its discretion and accept an amicus curiae brief in support of an interlocutory appeal filed by MDTC Members David Yates and Eric Conn.

With an assist from the MDTC amicus brief, written by Tim Diemer, the appeal was a success and the trial court's order denying the discovery was vacated.

Court Rules Update - August 2, 2011

In the last couple of weeks, the Michigan Supreme Court has issued two significant orders relating to amendments to the Michigan Court Rules of 1985 and the Michigan Rules of Professional Conduct.

 

First, on June 29, 2011, the Court – seemingly out of nowhere – issued an order adopting a large number of major changes to the rules regarding jury trials, including the adoption of a new MCR 2.513.  These changes have garnered a significant amount of attention in the legal press and in the general press as well.
